Episode 52 - Why is the stack size (80K) of the MP1 considered the effective stack?

According to Nick MP1 holds the effective stack of 80k while UTG's Stack is 50K. Doesn't the UTG player hold the effective stack? If so, the effective stack is 5% of 50k or $2500. The call amount of ($3,500) is way over the 5% cap criteria and accordingly this hand should've been folded and not called as it clearly violates the 5% rule!
